Personal Data Controller

The Privacy Policy of the Martensy.pl Online Shop, further referred to as: the Shop, sets out the rules for collecting, using and processing personal data obtained from the Customer by Alu Trading Sp. z o.o. with its registered office in Al. Jerozolimskie 49/20, 00-697 Warsaw, Poland, holding tax ID number (NIP): 5261035299, statistical number (REGON): 011210223, entered in the Polish Court Register under number KRS 0000242314, being the Personal Data Controller, via the Shop website.

 

Personal Data

 

Personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. The Shop makes every effort to ensure that the personal data entrusted by the Customers is duly protected. The Shop ensures that the data collected is processed in accordance with the law, collected for legitimate purposes and is adequate, as required for specified purposes.

 

Right to Access, Rectify or Object

 

Under the provisions of the General Regulation on Personal Data Protection, providing data is voluntary and everyone has the right to access (pursuant to article 15 of GDPR), rectify (pursuant to article 16 of GDPR) and delete data (pursuant to article 17 of GDPR), limit its processing (pursuant to article 18 of GDPR), transfer it (pursuant to article 20 of GDPR), not be subject to automated decision making, including profiling, as well as the right to object to personal data processing (pursuant to article 21 of GDPR). The Customer may also revoke their prior consent at any time.

 

Any notices or requests regarding the personal data can be made via e-mail sent at sklep@martensy.pl or letter sent to the address: Alu Trading Sp. z o.o. with its registered office in Al. Jerozolimskie 49/20, 00-697 Warsaw, Poland.

 

Personal Data Collection

 

Personal data obtained from the Customers:

- full name;

- address;

- phone number;

- e-mail address;

- if an invoice is issued: business name, address and NIP/PESEL number.

 

Use of Personal Data

 

Providing personal data is voluntary but necessary, e.g. to register in the Shop, for an order to be processed, to subscribe to the Newsletter or to use other functionalities of the Shop. If the required data is not provided, you may encounter problems placing the order or certain functionalities of the Shop can be unavailable.

 

Customers’ personal data collected for the following purposes (article 6.1 GDPR):

 

- to adjust the Shop and its operation to the Customer's needs;

- to handle orders, replacements, returns, complaints and warranties;

- to generate internal statistics;

- to perform marketing activities;

- to communicate via the Newsletter with the Customer's prior consent;

- to ensure the safety and reliability of the Shop;

- to optimise and increase the efficiency of services provided by the Controller;

- for accounting and tax purposes;

- to exchange correspondence with the Customers, including responding to their messages.

 

Retention Period

Personal data will be kept until:

- the User's account in the Shop has been deleted upon the Customer's request;

- the User's account in the Shop has been deleted if the Customer withdraws their consent to their data being processed;

- an objection has been raised against the Customer's personal data being processed.

In such case, only archival information about transactions concluded by the Customer which needs to be stored under the legal regulations applicable to us and is related to claims to be possibly raised e.g. under the implied warranty or warranty will then remain in our systems so that we can raise claims or defend against third party claims under the Polish Civil Code.

 

User’s Personal Data can be stored for the following periods of time:

 

- if you use the Online Shop, for 5 years from your last use of the Online Shop;

- in the case of marketing activities, until the Customer objects;

- in the case of activities related to cookie technology and similar technologies, until the User objects and until the User removes these files in the settings of their browsers in their devices;

- if Personal Data processing is subject to the Customer's consent, Personal Data can be processed only until the Customer's consent has been withdrawn, whichever is longer.

 

Data Security

 

Personal data can be transferred to third parties only for the order to be processed, a commercial offer to be presented in the form of the Newsletter, subject to the Customer’s prior consent, and for marketing purposes, including granting individualised discounts and access to promotions, referral and loyalty programmes. The data is limited only to the necessary minimum, with the highest level of security being ensured.

The Customer's personal data will be transferred outside the European Economic Area to Google LLC.

 

All transmitted data is secured as a result of standard data protection clauses, as adopted under the European Commission's decision and data processing agreements compliant with the GDPR requirements, being applied.

The Shop can process personal data in an automated way, also by profiling. These measures neither cause any legal effects for the Customer nor significantly influence their decisions. Personal data profiling consists in the Customer's data being processed in order to present advertisements tailored to their preferences and interests.

The Customer has the right to lodge a complaint with the President of the Personal Data Protection Office.

 

Online Services and Cookies

 

Cookies are small text files stored in users' terminal devices that enable the proper operation of the Shop.


The Shop does not automatically collect any data except for the data contained in the Cookies (cookies) during the visits in the Shop.

The martensy.pl website uses two types of cookies:


 “session” and “permanent” cookies. “Session” cookies are temporary files which are stored in the Customer's terminal device until the Customer logs out, leaves the website or closes the Internet browser. “Permanent” cookies that are stored in the Customer's terminal device for a time specified in the cookie parameters or until deleted by the Customer.

The Customer can independently and at any time change the settings for the Cookies in the browser settings on their device. They can also delete the Cookies at any time.

The Shop also uses third party cookies in order to optimise the operation of the online shop and for marketing purposes of the companies cooperating with the Shop. Companies cooperating with the Shop: Facebook, Instagram, Twitter, Pinterest, Google+, Opineo, Refericon, Savecart, Google AdWords, Google Analytics, HotJar.

 

Acceptance of this Privacy Policy

 

By using the website, you accept the terms and conditions of this privacy policy.

The Data Controller may change this Privacy Policy at any time as a result of technical changes being made in the Shop, new functionalities being added or the Shop being modified. Please check the content of the site regularly.
